PLEASE READ THESE TERMS OF SERVICE ("TERMS") CAREFULLY BEFORE USING LIBERTY SWAP. BY ACCESSING OR USING THE PLATFORM IN ANY MANNER, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT ACCEPT THESE TERMS, YOU MAY NOT ACCESS OR USE THE PLATFORM.
1. Introduction
These Terms of Service (βTermsβ) govern your access to and use of the Liberty Swap decentralized platform, which includes but is not limited to our websites, application interfaces, APIs, smart contracts, and related communication tools (collectively, the βServicesβ).
By using the Services, whether directly or through any third-party tool or integration, you acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not agree, you must not access or use the Services.
These Terms constitute a binding agreement between you (βUser,β βyou,β βyourβ) and Liberty Swap, a decentralized software platform, its core contributors, affiliated developers, or operational partners (collectively, βLiberty Swap,β βwe,β βour,β or βusβ). Certain legal obligations herein may survive termination of your use of the Services.
By accessing, browsing, interacting with, or otherwise using any part of the Services, you affirm that you have read, understood, and agree to be legally bound by these Terms and any policies referenced herein, including our [Privacy Policy].
2. Scope of Services
Liberty Swap is a multi-chain, non-custodial decentralized exchange (DEX) infrastructure that enables users to conduct secure asset swaps across supported blockchain networks. It is built to enhance user autonomy and privacy through advanced cryptographic and routing mechanisms.
Liberty Swap enables users to:
Conduct decentralized digital asset swaps across various Layer 1 and Layer 2 blockchain protocols;
Choose between Standard Swap and Private Swap modes, with the latter integrating privacy mechanisms such as randomized routing, time-delayed execution, and optional use of privacy-centric networks (e.g., Monero);
Utilize the Platform without creating user accounts or undergoing centralized custody or control by Liberty Swap;
Connect via non-custodial wallets to perform smart contract interactions directly.
All swaps are facilitated through smart contracts and/or relayed across privacy bridges, ensuring that Liberty Swap does not ever hold, custody, or have access to your digital assets.
Liberty Swap provides limited support services through encrypted communication channels strictly for operational assistance, not for asset management or user account intervention.
We offer two distinct transaction modes:
2.1 Standard Mode
This mode supports general cross-chain swaps through optimized routing algorithms. Users may conduct swaps via transparent smart contract interactions, which typically settle through visible chain operations.
2.2 Private Mode
This mode adds layers of transaction privacy using one or more of the following techniques:
Obfuscation through randomized intermediaries.
Integration with privacy-focused blockchains (e.g., Monero, Zcash, or Aztec).
Transaction delays or batching to prevent temporal correlation.
Non-interactive zero-knowledge proof (zk-SNARKs) usage where applicable.
We do not offer financial advice, investment recommendations, or custodial services. The Services are software utilities facilitating transaction execution; users are wholly responsible for their own actions and decision-making.
3. Eligibility
3.1 Age Requirements
To access or use the Services, you must be at least eighteen (18) years of age or the age of majority in your jurisdiction, whichever is older.
3.2 Legal Capacity
You represent and warrant that you have the full legal right, authority, and capacity to enter into and comply with these Terms.
3.3 Prohibited Jurisdictions
You may not use the Services if you are a resident, citizen, or located in any country or region that is:
Sanctioned by the United Nations, United States (OFAC), European Union, or United Kingdom.
Identified on the Financial Action Task Force (FATF) high-risk list.
Subject to legal or regulatory restrictions applicable to digital assets.
We reserve the right to geo-block access or suspend Services for users located in restricted jurisdictions, and we may use publicly available tools and third-party services for geographic validation.
4. Non-Custodial Infrastructure
4.1 No Custody
Liberty Swap is a non-custodial infrastructure. At no point does Liberty Swap have possession, control, or access to user funds, private keys, or signing credentials. You maintain full custody of your digital assets at all times.
4.2 Wallet Requirements
All transactions initiated via Liberty Swap require the use of a self-custodial wallet compatible with the blockchain(s) you wish to transact on. Examples include MetaMask, Rabby, Ledger, Trezor, Trust Wallet, and others supported via WalletConnect.
4.3 Transaction Finality
Transactions submitted through the Services are executed directly on the blockchain via user-controlled wallets. These are irreversible and cannot be reversed, canceled, or modified once confirmed by the network.
4.4 Smart Contract Use
Liberty Swap leverages autonomous smart contracts deployed on various public blockchain networks. Users interact with these contracts at their own risk. We do not control or alter the execution logic of deployed smart contracts once verified and published.
5. Wallet Connectivity and Interoperability
5.1 Supported Wallets
Liberty Swap supports a broad range of EVM-compatible wallets, hardware wallets, and browser extensions. Users are responsible for verifying wallet security and compatibility before initiating any transaction.
5.2 Key Management
We do not store seed phrases, recovery words, or passwords. You bear full responsibility for safeguarding your wallet credentials. If you lose access to your wallet, we cannot recover funds or provide technical intervention.
5.3 Cross-Chain Capabilities
Transactions involving different blockchains may require third-party bridges or relayers. Liberty Swap does not operate such bridges directly but may route through existing decentralized protocols. All bridge-related risks are borne by the user.
5.4 Integration Risks
Users who connect via third-party dApps, aggregators, or DeFi dashboards must understand and accept that Liberty Swap is not responsible for the reliability, security, or legality of those tools. You must independently evaluate the risks before proceeding.
6. Privacy Reference and Data Minimization
6.1 No Personally Identifiable Information Required
Liberty Swap is designed to operate without requiring personal data from users. We do not request, collect, or store personally identifiable information (PII) in the normal course of providing the Services.
6.2 Voluntary User Submissions
You may choose to contact us through optional forms, email, or encrypted messaging channels to seek support or provide feedback. In such cases, any information you voluntarily submit will be processed in accordance with our Privacy Policy.
6.3 On-Chain Transparency and Limitations
All blockchain-based transactions are inherently public. While Liberty Swap does not associate wallets with identities, transactions may still be traceable using blockchain analytics. Users must take independent steps to ensure privacy, especially when transacting on public chains.
6.4 Reference to Privacy Policy
Please review the full Liberty Swap Privacy Policy to understand how we handle user data, including anonymized telemetry (where applicable), cookies, or third-party analytics. That policy governs the collection, storage, and protection of information outside the scope of this Terms of Service.
7. Legal Compliance and Regulatory Considerations
7.1 Sanctions and Export Controls
You represent that you are not subject to trade restrictions or sanctions imposed by regulatory bodies including, but not limited to:
The U.S. Department of the Treasuryβs Office of Foreign Assets Control (OFAC)
The European Unionβs consolidated sanctions list
Her Majestyβs Treasury (UK) Sanctions List
United Nations Security Council Sanctions Committees
We reserve the right to block access from such jurisdictions or terminate access by users who breach these requirements.
7.2 Financial Compliance
While Liberty Swap does not provide regulated financial services or custodial asset management, we are committed to compliance with applicable AML (Anti-Money Laundering), CTF (Counter-Terrorist Financing), and international obligations. This may include:
Rate-limiting usage patterns indicative of layering, smurfing, or structuring
Flagging transactions with confirmed links to illicit activity (e.g., sanctioned mixers, ransomware wallets)
Cooperating with competent authorities when compelled by legal process
7.3 Tax Obligations
Users are solely responsible for determining and fulfilling any tax obligations associated with their use of the Services. Liberty Swap does not issue tax documents, track profit/loss, or report to tax authorities. We recommend consulting a qualified tax advisor for jurisdiction-specific guidance.
7.4 Legal Investigations
In the event of a law enforcement or regulatory request that meets applicable legal thresholds, Liberty Swap contributors and infrastructure providers may cooperate as necessary. We reserve the right to implement selective or full protocol limitations to comply with such mandates.
7.5 No Securities or Derivatives
Tokens and digital assets accessible via Liberty Swap are not offered or sold by Liberty Swap. We do not offer investment contracts, derivative instruments, or financial products that constitute securities under applicable law. Users are responsible for determining whether their activity is lawful under local securities regulation.
8. User Conduct and Prohibited Activity
8.1 Prohibited Conduct
You agree to use the Platform solely for lawful, ethical, and non-fraudulent purposes. You further agree to not engage in any of the following activities:
Violating any law, regulation, or court order in connection with the use of the Services.
Accessing or attempting to access another userβs wallet, transaction, or information without permission.
Deploying bots or automated software to manipulate liquidity, frontrun transactions, or perform denial-of-service attacks.
Uploading viruses, malware, or malicious scripts to the interface or any third-party node infrastructure.
Using the protocol in connection with money laundering, terrorist financing, human trafficking, or the distribution of child sexual abuse material.
8.2 Network Abuse and Interference
You agree not to interfere with the normal operation of Liberty Swap or associated smart contracts. This includes refraining from:
Exploiting bugs or protocol inefficiencies to gain unfair advantages.
Conducting stress testing or penetration testing without written permission.
Attempting to reverse engineer smart contracts or backend services outside the bounds of open-source licenses.
8.3 Harmful or Fraudulent Behavior
The following actions are expressly forbidden:
Impersonating Liberty Swap, its contributors, or partners.
Creating false or misleading content purporting to be associated with Liberty Swap.
Soliciting personal data from other users under false pretenses.
Using the Liberty Swap brand in scams, phishing campaigns, or copycat websites.
8.4 Enforcement and Remedies
Violation of these provisions may result in one or more of the following:
IP-based access blocking.
Reporting to blockchain analytics firms or regulatory entities.
Civil or criminal prosecution, if applicable.
Restriction from future governance participation or protocol improvements.
9. Transaction Mechanism and Fees
9.1 Transaction Finality
All transactions routed via Liberty Swap are executed on-chain through deterministic smart contract logic. By initiating a transaction, you authorize execution by the designated contract. Transactions are irreversible once broadcasted and mined.
9.2 Gas Fees
You are responsible for paying network gas fees required to process transactions on the underlying blockchains. These are separate from Liberty Swapβs protocol-level fees and may vary significantly depending on network congestion.
9.3 Protocol Fees
Certain swaps executed via the platform may incur protocol fees, which are transparently displayed before confirmation. These fees may be distributed to relayers, liquidity providers, developers, or future governance treasuries.
9.4 Refunds and Disputes
Due to the immutable nature of smart contract execution, Liberty Swap cannot offer refunds. If you believe your funds were misrouted due to a contract bug or third-party error, please contact support immediately. We may attempt to analyze the incident, but we do not guarantee fund recovery.
9.5 Delayed Settlements in Private Mode
Some Private Mode transactions may be subject to latency as part of their privacy-preserving mechanisms. In such cases, delays do not constitute failed transactions unless settlement exceeds pre-disclosed thresholds. By proceeding, you acknowledge and accept these potential delays.
10. Intellectual Property and License
10.1 Ownership of Materials
All content, codebases, architecture, algorithms, visual design, brand marks, and documentation associated with Liberty Swap are either:
Owned by the Liberty Swap core contributors,
Licensed under open-source protocols (e.g., MIT, GPL, or Apache), or
Used under fair-use or public domain licenses with attribution.
10.2 Brand Use
The Liberty Swap name, logo, and associated branding elements may not be used without express written permission. Unauthorized use may constitute trademark infringement.
10.3 Open-Source Licensing
Where applicable, specific parts of the protocol are open-source and published under permissive licenses. You are free to fork, audit, or extend these components under the terms of the applicable license. You may not claim them as proprietary, nor may you use Liberty Swap branding on modified forks.
10.4 Limited License to Users
You are granted a limited, non-exclusive, revocable license to access and use the Services solely for personal, non-commercial purposes in accordance with these Terms. This license does not permit resale, redistribution, or derivative commercial use of the Services or any Materials therein.
11. Disclaimers and No Warranties
11.1 Use at Your Own Risk
The Services are provided on an βas-isβ and βas-availableβ basis without warranties or representations of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, title, and non-infringement. Your use of the Services is entirely at your own risk.
11.2 No Warranty on Accuracy or Timeliness
We do not guarantee that information or data presented on the Liberty Swap interface (including token prices, pool balances, or route estimates) is current, complete, or accurate. Due to the decentralized and asynchronous nature of blockchain networks, price or routing data may be stale, incorrect, or delayed. Use third-party price oracles at your own discretion.
11.3 No Liability for Third-Party Integrations
We disclaim all responsibility and liability for the actions or omissions of any third-party protocols, wallets, bridges, explorers, or price feeds integrated into or referenced by the Liberty Swap platform. These tools are provided for user convenience only and may be subject to separate terms of use and privacy policies.
11.4 Smart Contract Risk
Although we conduct internal and community-based code audits where feasible, no smart contract can be guaranteed to be free from bugs, exploits, or attack vectors. You acknowledge the risk of smart contract vulnerabilities, including but not limited to reentrancy, flash loan manipulation, governance attacks, MEV exposure, or logic flaws.
11.5 No Financial Advice
Nothing in the Services constitutes investment, legal, tax, or accounting advice. We do not recommend or endorse any digital asset or transaction. You should consult with licensed professionals before engaging in any activity involving blockchain-based assets.
12. Risk Disclosures
12.1 Blockchain Risks
You acknowledge that all blockchain-based activities involve inherent risks, including but not limited to:
Finality failures or unexpected forks in the underlying chain.
Gas fee volatility or chain congestion.
Consensus layer failures, validator slashing, or oracle failure.
Miner or validator censorship or reordering.
12.2 Asset Volatility
Digital assets are subject to extreme price volatility, illiquidity, and speculative interest. You may lose some or all of the value of your assets when participating in swaps. We make no representations as to the risk, legality, or suitability of any specific asset or transaction.
12.3 Regulatory Uncertainty
The legal status of decentralized finance protocols, tokens, and privacy-enhancing technologies is evolving. Legislative and regulatory bodies in multiple jurisdictions may restrict, criminalize, or reclassify certain activities. You accept the risk that your use of Liberty Swap may become restricted or prohibited without notice.
12.4 Bridge and Cross-Chain Risk
When engaging in cross-chain transactions using bridge protocols, you are exposed to additional risks including but not limited to:
Custodial failures by the bridge provider.
Synthetic asset de-pegging.
Contract upgrade exploits or administrative key compromises.
Relayer failure or validator collusion.
12.5 Privacy Mode Limitations
Transactions routed through Privacy Mode may suffer from reduced reliability, longer confirmation times, and increased susceptibility to timing-based deanonymization. Privacy is not absolute, and advanced adversaries may still correlate transaction metadata. Use responsibly and combine with external measures (e.g., VPN, Tor) if needed.
12.6 Protocol Upgrades and Governance
Liberty Swap may be subject to protocol upgrades, parameter changes, or governance actions proposed and voted upon by the community or contributors. You acknowledge that such changes may materially impact the protocolβs operation, fees, supported chains, or token compatibility.
13. Limitation of Liability
13.1 No Liability for Damages
To the fullest extent permitted by law, in no event shall Liberty Swap, its developers, contributors, maintainers, affiliates, or service providers be liable for any indirect, incidental, special, punitive, or consequential damages, including but not limited to:
Lost profits, revenue, or business opportunity.
Loss of data or digital assets.
Errors in smart contract execution or unintended outcomes.
Service interruptions or unauthorized access.
This limitation applies even if we were advised of the possibility of such damages.
13.2 Cap on Liability
To the extent a court of competent jurisdiction finds Liberty Swap liable despite the above disclaimers, our aggregate liability to you shall not exceed the lesser of (a) USD $100 or (b) the total amount of protocol fees paid by you in the preceding 12 months.
13.3 Force Majeure
We shall not be liable for any delay or failure in performance resulting from acts beyond our reasonable control, including but not limited to acts of God, internet outages, network disruptions, denial-of-service attacks, protocol layer bugs, regulatory interventions, or war.
14. Indemnification
14.1 Your Obligation to Indemnify
You agree to indemnify, defend, and hold harmless Liberty Swap, its contributors, developers, node operators, affiliates, and partners from and against any and all third-party claims, actions, damages, losses, liabilities, costs, or expenses (including legal fees) arising out of or related to:
Your use of the Services.
Your violation of these Terms.
Your violation of any applicable law or regulation.
Your infringement of any intellectual property or privacy rights.
14.2 Defense and Control
We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate fully with us in asserting any available defenses.
14.3 Survival
This indemnification obligation shall survive any termination of your access to the Services and/or these Terms.
15. Governing Law and Dispute Resolution
These Terms shall be governed and construed under the laws of the jurisdiction in which Liberty Swap is legally established or otherwise operates.
Any dispute, controversy, or claim arising out of or in connection with these Terms or the Platform shall be settled by confidential binding arbitration, unless prohibited by law. The arbitration shall be conducted under the rules of a recognized arbitral institution, and the decision rendered shall be final and binding.
16. Termination
You may discontinue use of the Services at any time. Provisions of these Terms that by their nature should survive termination shall remain in effect, including but not limited to: intellectual property, disclaimers, limitation of liability, and indemnification.
17. Modifications to Terms
We reserve the right to update or modify these Terms at any time. Changes will become effective upon posting the updated Terms on our official website or interface. We may provide advance notice where feasible, but it is your responsibility to regularly review the Terms.
Your continued use of the Services after any such updates constitutes acceptance of the revised Terms.
18. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable under applicable law, the remaining provisions shall remain in full force and effect.
19. Entire Agreement
These Terms, together with any additional terms or policies referenced herein (including our Privacy Policy), constitute the entire agreement between you and Liberty Swap and supersede all prior or contemporaneous understandings.
